Term Condition

OCD (Applied) Trademark registration is an intellectual property of Naina Services LLP.


OCD is an On-demand laundry delivery service that enables users to schedule pickup and delivery to their home, business, or apartment using OCD Platform.


Definitions


  1. OCD/We/Our/Us: Naina Services LLP, Panchkula, Haryana, India;
  2. OCD Platform: Our website and mobile Application;
  3. User/you/your: End User of the OCD Platform;
  4. Item: any garment/cloth or article or products picked-up from you in connection with an Order;
  5. Order: your order for the Services as set out in the order form submitted via OCD Platform;
  6. Services: Any laundry or cleaning services provided by us on our Platform to your nominated address;
  7. Vendors: any third party with which we contract in order to assist us in providing the Services;
  8. Contract: legal binding between user and us for completion of order;
  9. Event Outside Our Control: any occurrence or circumstances over which we have no control as described below and including but not limited to the unavailability of any Service Provider, key personnel or key materials without which We are unable to provide the Services; civil, natural or unnatural activities;
  10. Notify: any contact (app notifications/emails/messages/telephone/physical) by OCD with User;
  11. Terms: these terms and conditions as amended from time to time for which OCD reserves right to change anything, anytime;
  12. Contact: by e-mailing Us at support@oncleaningduty.com, or choosing support via the App.


Note- Company reserves the rights to cancel/modify/change the terms and conditions at any point in time without any prior intimation or notice. So, it becomes duty of user to read and understand the changes made in terms and conditions.

However, it is the current version which will apply to each Order when you place it.


Contract- Eligibility to use


Use of OCD platform is available only to persons who can legally enter into “Contract” under applicable laws.

Persons who are "incompetent to contract", under applicable laws are not eligible to use. OCD reserves the right to terminate your access, if we discover that you are under the legal age or suffers from any other disability under applicable laws.


Limitations to use


The Services, including, but not limited to, the text, content, photographs, images, video, audio, graphics, and any software (including any files or images incorporated in or generated by the software, or any data accompanying the software) available on or through the Services, or contained in the Services (“Materials”) are owned and operated by OCD. The Services and the Materials are protected by copyright, trademark, domain name, patent, trade secret, treaties and/or other proprietary rights and laws.

Except as otherwise indicated in the Services and except for the trademarks, service marks and trade names of other companies that are or may be displayed in the Services, all trademarks, service marks, and trade names are proprietary to OCD.


Stores


Stores and their information, displayed in the explore is for the selection of the services from a specific store of your liking, are provided on the geo-based location. All the information provided like images, graphics or otherwise with the store is not for any illegal use.

OCD store is a single or group of stores chosen by OCD for better standards management by us and it is used to provide the best services in the industry. It is subject to availability and at discretion of our choice.


Note- OCD store for your address may be automatically selected, in case of

  1. location change during the order placement and the selected store is not available.
  2. Undetailed order that is without items, from the home screen or without selecting a store.


Cart


It is virtual space where you can temporarily save the items, you want to buy while browsing.

To ensure the best experience: After 48 hours, your cart will be automatically cleared if the order is not completed. And you acknowledge that to provide better services and business purposes, during this period you may be notified regarding the cart and encouraged to place an order


Placing an Order


Please ensure that you check the details of your Order before submitting it, as we will not be liable to you for any errors you make. If you think that you may have made a mistake, please contact us. We will confirm any changes to your Order by updating it in your order list.

Submission of an Order does not create a contract between us. The contract arises when We confirm acceptance of your Order.

We will assign an order number to each Order and notify you of it when we accept the Order. Please quote the order number in all subsequent contact with us.

If for any reason we are unable to fulfil your Order, we will notify you.


Note- Express delivery/Premium service shall be charged at applicable rates and the Customer is required to check with the same at the respective Vendor before availing such services.


Changes to your Order


You may make a change to an Order at any time before the Pick-up time set out in acceptance of your Order by contacting us.

With your consent and at our discretion, we may make a change to your Order as an alternative to cancelling it.


Cancelling or Rescheduling your Order


You have the following limited rights to cancel an Order. You may cancel your Order in the following circumstances: Up to 1 hour before the pick-up day and time set in order details or by contacting us.


Note- You acknowledge that once an order has been picked from you, we have begun to provide the Services to you and that any rights of cancellation you may have will be lost.

In the case that you require for your pick-up or delivery window to be rescheduled whilst your window is within 1 hour, you can reschedule within the available time frame. The reschedule is subject to availability.


Note- OCD reserves the right to apply additional fees for the rescheduling after the available time frame (i.e., normally within 3 days of original time)


Our rights to cancel your Order


We may cancel your Order and the contract between you and us in the following circumstances:

  1. as a result of an Event Outside Our Control; or
  2. if you fail to make order available for pick-up; or
  3. if we consider that any Item, is damaged or does not fall within those Items which we accept.


Note- If we cancel your Order, we will notify you, even if we have already started work on your order, we will not charge you anything, and you will not have to make any payment to us; and we will arrange to deliver the order to you at the original delivery time or as soon as reasonably possible.


Pick-up and Delivery


We will use reasonable endeavours to pick-up and Deliver Items at the times specified in the Order, but we cannot guarantee to do so. We use our best endeavours to notify you of any delays, but exclude any liability for any and all consequential losses which a customer may suffer as a result of late delivery.

If the order placed is non detailed that is without items, delivery partner will enter your order details during pick-up of order and it is at vendor’s discretion and your acknowledgement. Damaged items may be identified and denied by delivery partner as well as at the facility, as delivery partner may not be professional in the field.

If you are not available to accept delivery of Items, we will notify to reschedule re-delivery.


Note- If delivery is not possible due to customer being unavailable at the designated time, a re-delivery charge of ₹50.00 will be charged for each consequent attempt of delivery. You may reschedule the re-delivery after prepaying the final amount including additional charges.


Note- If you have failed to accept or reschedule delivery of an Item for more than 3 days after the delivery date specified in the order, an overstay charge of ₹30.00 will be charged for each passing day. You may reschedule re-delivery after prepaying the final amount including additional charges


Note- If you have failed to accept or reschedule redelivery of an Item for more than 60 days after the delivery date specified in the original order, we may dispose of the order items or donate it to an accredited charity of OCD's choice.

All order item(s) pick-up and deliveries must be acknowledged.

You may schedule to have order picked up from, or delivered to, a third party, on condition that you do so at your own risk and the third party is prepared to acknowledge on your behalf.

You may, by written instructions to us, request us to leave an Item in an agreed location without providing us with an acknowledgement. If you do so, it is at our discretion and entirely at your own risk, and we shall not be liable to you for any damage or loss of Items delivered on this basis.

You are responsible for ensuring that we and/or our vendors have such access (including free parking facilities) as may be reasonably required to carry out the Services.


Note- The Customer shall ensure that no valuables/belongings is/are handed over along with the order. OCD is not responsible for loss of or damage to any valuable or personal or non-cleanable items left in the garment(s)/ item(s) such as money, jewellery, or anything else.


Service standards


We will provide the Services with reasonable care and skill in accordance with good industry standards.

We will not be liable for any delay or non-performance of our Services where you have failed to provide accurate information in your Order, for example if an address is incomplete or inaccurate, or if you fail to accept delivery of Items in accordance with an order.

We will not be liable for any Items submitted to us that have an increased risk of damage, including, but not limited to, Items:

  1. with special requirements or instructions for cleaning;
  2. with no label indicating cleaning instructions;
  3. which are damaged or stained; and
  4. with no provided item photos in order placement details.
  5. bearing an extraneous or hazardous thing, e.g., pins, jewellery, coins, pens, etc.

and at our discretion and with your consent may agree to provide the Services at your risk in respect of those Items.


By weight Orders


Checking- Please ensure to thoroughly check all the garments for hazardous items e.g. coins, pens, keys, etc. as we hold no responsibility for any items lost or damaged as a result of the cleaning process.

Process- As we process a high volume we might not always be able to cater to personal requirements (e.g. temperature, washing powders, etc.).

Separation- We will separate the clothes into lights and darks for you. Although we will take the utmost care in doing this, we will accept no responsibility if there is any bleeding or colour transfer during the cleaning process.

Size of Bag- We will measure the laundry by weight at the facility and will be updated accordingly.

Damages- We will not be liable for damage to items, as we wash by the load and do not inspect the care labels of each garment and can’t provide special care to each item.

Tagging- Laundry items are tagged by the load and not individually tagged. Therefore, we cannot accept any liability for missing items.


If there is any problem with the Services:


Please contact us and tell us as soon as reasonably possible; You will not have to pay for us to deal with your complaint.

Complaints should be notified to us within 24 hours of delivery of order, if you believe that we are in breach of our obligations under these terms.


Price and payment


The price of the Services will be set out in order form as set out on the Platform and will be the prices in force at the time you place your Order. Our prices may change at any time, but price changes will not affect orders that we have accepted.

We reserve the right to charge a Service Fee, which may be subject to change, for the provision of our services. You will be notified of any applicable service fee and taxes prior to purchase on the checkout page on our Platform.

Some additional charges may be applicable in certain cases of rescheduling, express or otherwise.

Taxes may be charged over and above the prices mentioned on the OCD Platform. However, if the taxes change between the date, we accept your order and the date of payment, we will have to adjust the taxes that you pay.

Upon placing an Order, you can pay the payment as prepaid or pay on delivery. If your final total is greater than your order bill amount, we will update your order details accordingly. We take payment in form of cash or UPI or debit or credit card. If for any reason you are unable to make payment, we reserve the right to make non-delivery of the order. You must pay us final amount including the additional amount as applicable.

If order is prepaid and the final amount is greater than your paid amount, remaining amount should be paid before delivery of order.

In certain cases, prepayment is mandatory as mentioned above.


Our liability and Compensation/Refund policy


In the unlikely event of loss or damage to an item, OCD will pay compensation. It is considered reasonable for us to ask for receipts, bank or credit card statements confirming the purchase price prior to agreeing any compensation. If found liable, the compensation given will not include extra costs to purchase the Item, including but not limited to shipping costs, tailoring/altering costs, etc.

Our total liability to you in respect of the order is limited to ten times the price we charge for the Services, but not more than ₹2500.00 in case of regular and ₹4000.00 in case of premium service per order, given a proof of purchase is provided, showing the date of purchase and the value of the item.

You must inspect the Items following delivery, and if you believe that Items are lost or damaged, you must inform Us about such loss or damage within 24 hours of receiving the Items. We reserve the right to inspect and take pictures of any alleged damage to any Items.

We will not be responsible for any damage to items which:

  1. do not have the original cleaning instructions ticket attached;
  2. during order placement, were not photographed; or
  3. have been recleaned by you or a third party.

You acknowledge that We are not aware of the value of the Items, and We strongly recommend that you arrange insurance to cover the Items.

We will not be responsible to you for any loss or damage that is foreseeable. Loss or damage is foreseeable if it is an obvious consequence of clothe/item quality or design.

If you use the Services for any commercial, business or re-sale purpose, we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be responsible for any loss or damage, including, without limitation, any colour loss, shrinkage or other damage, resulting from the following:

  1. failure to notify us of any special requirements or instructions for cleaning the Item;
  2. the fact that the Item has no label indicating cleaning instructions;
  3. any existing damage to the Item at the time of pick-up;
  4. any extraneous or hazardous thing left in or on, e.g., pins, jewellery, coins, pens, buttons etc.;
  5. any extraneous packaging provided, including but not limited to: clothes hangers, suit bags;
  6. non acceptance of delivery;
  7. non availability for delivery;
  8. any normal wear and tear;
  9. incorrect labelling on the manufacturer's behalf, or incorrect instructions from you;
  10. items in weight Service.

We do not exclude or limit in any way our liability for:

  1. death or personal injury caused by negligence;
  2. fraud or fraudulent misrepresentation;
  3. defective/damaged products.

We will not be liable for any consequential loss.

We will not be liable for any damage to buttons, zips, and other similar parts.

Some of our facilities use a permanent heat-sealed sticker ticketing system, or a temporary pin. By placing an order with us, you agree that your Item(s) may be tagged in this manner. We will always try to position these as inconspicuously as possible. We strongly advise you not to remove these stickers, as we cannot accept liability for any damage caused by removal by you or a third party. Please contact Our Customer Service Team for support.

All payments regarding compensation will be paid through the original payment method in case of digital payment method or the details for transfer taken in the Discussion/query.

In the event we issue compensation for damage caused to an item(s) in our care, OCD reserves the right to retain permanent ownership of damaged item(s).


Events Outside Our Control


We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.

An Event Outside Our Control means any act or event beyond our reasonable control, or the reasonable control of our vendors including (without limitation) strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or closure or failure of public infrastructure or public or private telecommunications networks.

If an Event Outside Our Control takes place that affects the performance of Our obligations under these Terms:

  1. We will notify you as soon as reasonably possible; and
  2. Our obligations under these terms will be suspended and the time for performance of Our obligations will be extended for the duration of the Event Outside Our Control; or
  3. You may cancel your order as mentioned above, or We may cancel it as mentioned above.

Note- If your Order is cancelled, we will return your Item(s) to you at no cost to you.


OCD Quality Guarantee


We check each and every item before it is returned. However, if you are not completely satisfied then simply contact us within 24 hours of delivery, and we guarantee to re-clean your items free of charge. Any re-clean requests submitted after 24 hours will be considered on a discretionary basis.

To request re-cleaning for your items, please contact us, explain the problem and attach any relevant photos. A Customer Service agent will contact you to arrange a suitable time for repick-up.


Re-cleaning policy


The re-cleaning only applies to individual items which have been cleaned by OCD and the original ticket must be attached.

Please note, it is not always possible to remove stains. If we cannot remove a stain, customers might be informed according to the ticket which is attached to their items. In this instance, we are not able to offer a complimentary re-clean.


Coupons and promotions


Coupons are subject to expiry dates, availability and value for particular promotions.

Only one coupon or code may be used per transaction.

Coupons are strictly non-transferable, and have no cash value. Placing a coupon for sale is strictly prohibited and renders the coupon void.

OCD reserves the right to reject a coupon with reasonable cause.

OCD reserves the right to withdraw this offer at any time and without warning.

To redeem a coupon, you must present the code found on the coupon at checkout.

The minimum order value for orders using a coupon code may be applicable.

Coupons may be limited in non-detailed order or order without items.


Reviews, Feedback, Submissions


All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to our platform directly or otherwise disclosed, submitted or offered in connection with you, will remain our property. Such disclosure, submission or offer of any comments shall constitute an assignment to OCD of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the comments, thus, it exclusively owns all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise. OCD will be entitled to use, reproduce, disclose, modify, adapt, create.


Dispute Resolution


All Disputes will be resolved amicably through discussion when you contact us.

If unresolved, disputes are subject to the jurisdiction of courts in Chandigarh (INDIA) only.
